Terms & Conditions


Zamba Tours & Safaris Ltd.
 
Please take a few minutes to review the following:
These terms and conditions govern the relationship between Zamba Tours & Safaris Ltd. (herein after referred to as Zamba) and you, the purchaser and/or participant, and they apply to the tours and safaris as mutually agreed upon. No alterations to these terms and conditions may be made by any Zamba employee, authorized representative or agent, unless in writing by an officer of Zamba. All decisions and matters subject to Zamba discretion shall be made by an authorized officer of Zamba
 
Late Bookings
Bookings made within 30-days of departure are accepted at no penalty; however no hotel or lodge reservation will be done before receipt of an advance payment. In case of late bookings, it is possible that by the time an advance payment is received, one or more hotels/lodges might be full booked. We will then try to find a room in another hotel or lodge, with the price of the itinerary adjusted accordingly. Prospective clients are advised to reserve early to obtain their accommodations of choice, as some accommodations are sometimes booked up to 6 months ahead of time.
 
Participation
Persons not fit for long trips due to heart disease, chronic illness, physical handicap, advanced pregnancy and/or mental illness should not participate n these rigorous travel programs.
 
Departure Dates and Prices
All prices mentioned can be changed without notice until the day confirming your booking. The stated price for a tour or safari are based on all costs noted in the itinerary, and will generally included all expenses in respect of vehicle and driver, meals on safari, accommodation fees, and entrance fees to National Parks, Game Reserves and conservation areas. The price also includes tariffs, exchange rates and air-fares in effect at the time given. Zamba reserves the right to alter prices quoted should inflation, costs of fuel, labor or material, air fares or foreign exchange rates change.
 
Not Included in Tour Costs
Fees for obtaining passports or visas, excess baggage charges, inoculations, accident or baggage insurance, international airline tickets and respective taxes, airport departure taxes that are not included in the airline ticket, optional tours, any items of personal nature, such as phone calls, faxes or room service, and transportation not specifically listed as included. Beverages (liquor and soft drinks) and laundry are included at select properties and this will be specified.
 
Alterations to Tours
If between planning time and/or during actual travel operation, circumstances require changes, Zamba, and its suppliers of travel services, reserve the right to vary the itinerary and substitute components of any tour, if air schedule or surface transportation charges, security matters and/or events beyond our control make such alterations necessary. It is essential to understand that in Africa, local conditions are not always predictable and such occurrences as border closure, poor road conditions, etc. can and do from time to time cause delays, frustrations and diversions from the planner route. We will do our best to minimize inconveniences but cannot accept responsibility for matters which are clearly beyond our control. The company also reserves the right to decline, to accept, or retain any person as a member of any tour at any time, in which case an equitable amount will be refunded.
 
Transportation
On safari, Toyota Land Cruisers will always be used. However, for transportation to and from the airport or other destination, a four wheel minibus or coaches may be used. The company reserves the right to employ the service of subcontractors. An English-speaking driver guide is included.
 
Cancellation Policy
The following terms apply effective as of the date Zamba receives written notice of cancellation.
 
More than 30 days prior to departure: 30% of tour cost
14-29 days prior to departure: 50% of tour cost
0-13 days prior to departure: 100% of tour cost
 
Refund of Unused Arrangements
If you cancel your tour while the tour is in progress, there will not be any refund for the unused portion.
 
Hotel Booking Only
If you only want to book a hotel, without booking a safari, a 5% reservation charge will apply, with a minimum of 25 USD and a maximum of 100 USD. Full payment is required upfront.
 
Alterations to Confirmed Bookings
If you decide to change any portion of your confirmed arrangements up to 30 days prior to departure, we will attempt to assist you and charge only what is necessary to reschedule accommodations, airline flights, and the like.
 
Cancellation Insurance
We strongly advise you to purchase trip cancellation insurance. This can protect you from financial loss in almost all circumstances. A comparison of several travel insurance policies along with their coverages can be found at www.insuremytrip.com.
 
Accommodation & Single Room Policy
Hotel/Lodge/Campsite are named as an indication of category only, and rooms may be reserved at similar hotel/lodge, unless a specific request is made. Single rooms are available at a supplementary rate and are subject to availability. Due to intermittent shortages of accommodations on safari, a single room cannot always be guaranteed, even if paid for in advance. If single accommodations are not provided, and appropriate refund will be made upon your return. If you are traveling alone and wish to share accommodations, Zamba will do what they can to find a roommate on your behalf, but it is not guaranteed.
 
Baggage
The airlines permit economy class passengers to carry 2 average sized luggages for which specific measurements and weight are written in their tariffs. Carriers have specific tariffs that apply to carry-on baggage as well. One average sized luggage, preferably soft-sided, will be carried on safari; however, clients who will be traveling by light aircraft on safari must carry medium sized soft luggage or duffel bags when flying sectors in small light aircraft which have limited space for baggage and a weight restriction to be advised. City hotels do store luggage for guests while they are out on safari.
 
Also, keep in mind that suitcases will not be carried up Mount Kilimanjaro or Mount Meru. Only soft-sided luggage or duffel bags not exceeding 10 kg will be carried up these mountains.
 
Health Requirements
Zamba endeavors to provide the latest information concerning the mandatory health requirements for our destinations, but shall not assume responsibility for the accuracy of this information. Malaria is endemic to Tanzania and precautions must be taken. Also, there is a recent requirement of a yellow fever vaccine to enter Tanzania. See your health practitioner for advice. Prior to travel, required inoculations, if any, must be recorded by client’s health practitioner on a valid vaccination certificate, which the client must carry for proof of inoculation where required. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking.
 
Zamba Responsibility
It must be clearly understood that these are adventure safaris and there are certain dangers and risks which are inevitable. Whilst every care is taken for the safety and comfort of our clients, the company accepts no liability for all or any of the following:

  • Damage or loss of property of any client, howsoever caused.
  • Sickness, infection, injury or death of the clients, howsoever caused
  • Change of the itinerary due to road and weather conditions
  • Damages, directly or indirectly, arising out of delays in departure or arrival including delays occasioned by the missing of road, rail, ship, or aircraft connections
  • War, and other calamities which may occur while on safari

It is therefore understood, on receiving a client’s booking that necessary insurance covers against these and other risks have been taken care of by the client. All of the above and other unexpected situations can arise before or during any type of vacation. Such an event might cause you to cut short your vacation or cause your trip to be cancelled altogether. Unfortunately, because of the costs incurred by the tour operator, any cancellation after booking incurs financial penalties, up to and including loss of the entire package price. That is why we strongly recommend a Travel Protection Plan. Clients are responsible for their own personal travel insurance. Clients are advised to check whether their insurance covers trips to Africa. Zamba Tours & Safaris is not responsible for theft or loss of baggage. We therefore recommend baggage insurance.
 
Liability
The company and its agents act only as agent or agents in all matters relating to tours. The company’s liability carried in its own is governed by the respective laws of the country and all claims. The company and agents shall not be liable for injury, delays, loss, or damage in any manner. The company’s liability to passengers carried in its own vehicle is governed by the laws of the country in which the tour takes place and no other country. All claims are subject to the jurisdiction of the courts of the country in which the actions arise. The company reserves the right to employ subcontractors for all or part of the service. While every care is taken, the company shall not be held responsible for loss or damages to baggage.
 
Zamba acts as an agent and purchases transportation (by aircraft, coach, train, vessel, or otherwise), hotel and other lodging accommodations, restaurant, ground handling and other services from various independent suppliers, who are disclosed principals. All such persons and entities are independent contractors. As a result Zamba is not liable for any negligent or willful act of any such person or entity or of any third person.
 
The transportation, accommodations and other services provided by the ground and air operators offered are subject to the terms and conditions contained in the Websites, tickets, exchange orders or vouchers issued by them and/or their suppliers. Because Zamba does not have the right to control the operations of the independent operators and their suppliers or any third person, IT CANNOT BE LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE which may arise out of these services.
 
In addition and without limitation, Zamba is not responsible for any injury, loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force Majeure, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time.
 
Risks
Zamba draws your attention to the fact that there are certain inherent risks in traveling to areas of the third world, where wild life is prevalent, and safari camps are by their nature remote. Your participation constitutes acceptance at your own risk, which include but are not limited to risks of hiking, walking safaris, (for example, equipment failures, ice or other trail obstructions) and in all trips there are also the ever present dangers of undomesticated and wild animals, inaccessibility to medical attention and difficulty in evacuation from remote locations in the case of a medical emergency. Passenger assumes all such risks with regard to these possibilities.
 
It is your sole responsibility to seek and take all appropriate medical advice relevant to your health prior to departure as to whether or not you are fit enough to undertake the trip booked. Zamba shall not be liable for illness, injury, or death sustained on a program sold by Zamba, which is not due to the gross negligence of Zamba, its officers, employees, authorized representatives or agents whomsoever.
 
Force Majeure
‘Force Majeure’ means, in relation to Zamba, any circumstances beyond the reasonable control of Zamba (including, but without limitation, acts of God, explosion, flood, tempest, fire or accident, war or threat of war declared or undeclared, sabotage, insurrection, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions or other untoward occurrences).
 
If Zamba is affected by Fore Majeure it shall forthwith notify you of the nature and extent there of.
 
Zamba shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure.
 
If Zamba, and/or any of its travel suppliers, are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Payment of any refund by Zamba to you as a result of the non-performance of any of Zamba’s obligations hereunder shall remain in its sole and absolute discretion although Zamba shall use its reasonable endeavors to reimburse you where possible. However, Zamba shall be entitled to deduct from any refund recoverable the reasonable actual and potential costs to Zamba of the Force Majeure.
 
Regarding civil unrest, once Zamba has investigated the prevailing situation, as it deems fit, it shall remain in Zamba’s sole and absolute discretion whether to proceed with the trip. You may in such circumstances cancel the trip. However, if, after having made all reasonable and proper inquiries, Zamba is of the opinion that the trip may proceed, no refund will be payable to you and the provisions stated under Cancellation Policy shall apply.
 
Insurance
Zamba strongly recommends that you obtain insurance that covers at least the following:

  • accidental death and disability
  • emergency medical evacuation and repatriation
  • trip cancellation/interruption
  • trip default protection
  • trip delay
  • major medical circumstances
  • lose luggage & personal effects

Consent
The advance payment or any other partial payment for a reservation on a safari constitutes consent to all provisions of the conditions and general information contained in this brochure. The terms under which you agree to take these safaris cannot be changed or amended except in writing signed by an authorized officer by Zamba.
 
Complaints
If you have cause to complain whilst on holiday you must bring it to the attention of the guide or other local representative who will do their best to rectify the situation. It is unreasonable to take no action whilst on holiday and to complain upon return.
 
Airlines
The passenger contract in use by the carriers concerned, when issued, shall constitute the sole contract between the transportation companies and the purchase of this tour and/or passengers.
